Welcome to Klickks (“Klickks”, “we”, “us” or “our”).
Klickks is a platform designed to help customers discover photographers, view available profiles and portfolios, and connect with photographers directly.
Klickks acts as a discovery and connection platform. Unless a particular service is expressly identified as being provided by Klickks, Klickks does not provide photography services, manage customer orders, negotiate contracts, process or hold payments, supervise conversations, or manage delivery of services between customers and photographers.
These Terms & Conditions govern your access to and use of the Klickks website, mobile application and related services.
By accessing or using Klickks, you agree to these Terms. If you do not agree, please discontinue using the platform.
Klickks provides a platform through which customers and photographers can discover one another and initiate direct contact.
Klickks may display photographer profiles, portfolios, photographs, descriptions, service categories, locations, contact details and other information supplied by photographers or obtained through permitted platform operations.
Unless expressly stated otherwise, Klickks:
Features that Klickks expressly introduces in the future may be governed by additional terms. The description above applies to the discovery and connection service and does not override any service-specific terms.
Photographers and customers act independently of Klickks.
Any engagement resulting from a connection made through Klickks is an independent arrangement between the relevant parties. The parties are responsible for agreeing upon the scope of services, pricing, deliverables, timelines, payment methods, cancellation conditions, refunds, intellectual property rights and other contractual terms.
Klickks is not a party to those agreements merely because the parties discovered one another on the platform.
Customers and photographers are responsible for understanding and complying with their respective legal obligations.
Klickks does not guarantee the identity, legal status, qualifications, experience, ownership, reputation, availability, financial reliability or conduct of any customer or photographer unless a specific verification is expressly disclosed.
The presence of a profile, portfolio, badge, rating or listing must not be treated as a guarantee of authenticity, competence, safety or performance.
Before booking a photographer, sharing sensitive information or transferring money, customers should independently verify the photographer. This may include:
Photographers should independently verify customer identity and contact information, event details, payment arrangements and other relevant circumstances before accepting work.
Users must not impersonate another person, misrepresent their credentials, submit fraudulent information or misuse another person's identity or content.
Customers and photographers must independently document their transactions.
Before confirming an order or transferring money, customers should obtain a written quotation specifying the services, pricing, taxes where applicable, deliverables, timelines, cancellation terms and payment conditions.
The parties should also obtain appropriate booking confirmations, invoices, receipts and other transaction records.
Photographers are responsible for issuing invoices and receipts where required by applicable law. Customers are responsible for retaining their payment confirmations and contractual records.
Klickks does not issue invoices for photography services supplied independently by photographers, does not guarantee the accuracy of their quotations and does not determine the tax treatment of their transactions.
These provisions do not remove any invoicing, tax or consumer-law obligation that may apply to Klickks itself.
Klickks does not process, collect, hold or settle payments for independent photographer orders under its discovery-only service model.
Payments made directly to a photographer, including advance payments, deposits, milestone payments or final balances, are arranged between the customer and photographer.
Klickks is not responsible for:
Customers and photographers should resolve payment-related matters directly with each other and, where appropriate, their bank, payment provider or competent authority.
Nothing in this section excludes any responsibility that applicable law places on Klickks for its own conduct.
Klickks does not manage or supervise orders arranged independently between users.
The photographer and customer are responsible for all order-related matters, including:
Klickks does not guarantee that a photographer will be available, that an order will be completed, or that the finished work will meet a particular quality standard.
Any promise or warranty concerning photography services must be confirmed directly with the photographer in writing.
Users decide whether to contact one another and what information to disclose directly, subject to applicable law and the platform's Privacy Policy.
Klickks does not supervise private communications conducted outside the platform and is not responsible for how users independently use, store, forward, publish or disclose information received from one another.
Customers should avoid sending unnecessary sensitive personal information, identity documents, financial credentials, passwords or private photographs.
Photographers must obtain appropriate permissions before collecting or using customers' photographs, personal information or other materials.
Users must not misuse personal information, publish private content without lawful authority, or use information obtained through Klickks for harassment, fraud, unsolicited marketing or other unlawful purposes.
Where Klickks itself collects or shares personal data, it will handle that processing in accordance with its Privacy Policy and applicable law.
Users are responsible for information, photographs, portfolio material, descriptions, reviews and other content they submit or publish.
You represent that you have the rights, permissions and legal authority necessary to submit such content and to permit its intended display on Klickks.
You must not upload or publish content that is unlawful, fraudulent, misleading, defamatory, infringing, abusive, invasive of privacy or otherwise prohibited by applicable law.
Klickks may, subject to applicable law and its operational capabilities, remove, restrict or suspend content or profiles that appear fraudulent, harmful, infringing or in violation of these Terms.
Klickks does not guarantee that every listing or item of user-provided content is independently verified or error-free.
Users agree not to:
Klickks may restrict access, suspend accounts or take other proportionate action where justified by these Terms or applicable law.
Klickks provides discovery and connection functionality on an as-available basis.
To the extent permitted by law, Klickks does not warrant uninterrupted availability, error-free listings, uninterrupted connectivity, the accuracy of all user-supplied information or the success of any connection between users.
Klickks does not guarantee bookings, customer leads, business revenue, photographer performance or customer satisfaction.
To the maximum extent permitted by applicable law, Klickks shall not be liable for losses arising solely from independent arrangements between customers and photographers, including:
Klickks does not disclaim responsibility for its own acts or omissions where liability cannot lawfully be excluded or limited, including any non-excludable statutory rights or obligations.
Nothing in these Terms limits a user's rights under applicable consumer-protection, data-protection or other mandatory laws.
To the extent permitted by law, a user may be responsible for losses, claims and reasonable costs arising from that user's unlawful conduct, fraud, infringement of third-party rights or material breach of these Terms.
This clause does not require a user to indemnify Klickks for losses caused by Klickks' own unlawful conduct or negligence where such indemnity would be prohibited by law.
Klickks may suspend, restrict or terminate access where reasonably necessary for security, fraud prevention, misuse, legal compliance or breach of these Terms.
Users may stop using Klickks and may request account deletion in accordance with the Data Deletion Policy.
Account termination does not automatically cancel or resolve independent agreements between customers and photographers.
Use of Klickks is also governed by the Klickks Privacy Policy and Data Deletion Policy, which explain how personal information is handled and how deletion requests may be submitted.
These policies form part of the platform's published terms to the extent permitted by law.

Klickks will handle complaints according to the applicable legal requirements and its published grievance process.
Complaints concerning an independent photographer's service, payment or order should ordinarily be raised directly with that photographer. This does not prevent a user from reporting suspected fraud or making a complaint to a competent authority.
Klickks may update these Terms to reflect changes in its services, business model, technology or legal obligations.
Material changes will be communicated through appropriate platform notices or other legally required means. Continued use after revised terms take effect constitutes acceptance only to the extent permitted by applicable law.
These Terms are governed by the laws of India.
Subject to mandatory consumer rights and applicable jurisdictional requirements, courts of competent jurisdiction in Bengaluru, Karnataka, shall have jurisdiction over disputes concerning these Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.
